Use Giggle for personal name discovery. Don't misuse the Service. Giggle Plus subscriptions auto-renew until you cancel in the App Store or Google Play. Apple and Google handle refunds. Ontario law governs these Terms, and nothing here takes away the consumer rights Canadian law gives you.
These Terms of Service ("Terms") are a legal agreement between you and L12 Industries ("L12 Industries", "we", "our", or "us"), operating as Giggle, governing your use of the Giggle website at gigglebaby.app, the Giggle mobile applications, and related APIs (together, the "Service"). By accessing or using the Service, or by tapping to accept these Terms where that option is presented, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Some features may be subject to additional rules or guidelines that we post in the Service. Where posted, those rules form part of these Terms.
These Terms do not require you to give up your right to go to court, and they do not contain a mandatory arbitration clause or a class action waiver. Canadian consumer protection law limits the effect of such clauses, and we have not included them.
Giggle is operated by L12 Industries, based in Toronto, Ontario, Canada. For questions about these Terms, contact support@gigglebaby.app.
You must be at least 18 years old to use the Service. The Service is intended for adults making baby-name or related naming decisions, and it is not directed to minors. If you are under 18, do not use the Service or create an account.
By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms. If we learn that an account belongs to someone under 18, we may suspend or close it.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Provide accurate and complete information when you register, and keep it current. Notify us promptly at support@gigglebaby.app if you suspect unauthorized access to your account.
You may close your account at any time by contacting support@gigglebaby.app or privacy@gigglebaby.app, as described in our Privacy Policy. We may suspend or terminate accounts that violate these Terms, appear compromised, or create risk to the Service or other users.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial name discovery.
You agree not to:
• Misuse the Service, interfere with its operation, or attempt unauthorized access to systems or data • License, sell, rent, lease, transfer, assign, distribute, or otherwise commercially exploit the Service or its content • Reverse engineer, decompile, or attempt to extract source code except where applicable law prohibits this restriction • Use the Service in order to build or improve a similar or competing product or service • Scrape, harvest, or bulk-download the name catalog or APIs in a way that burdens or circumvents the Service • Abuse AI or discovery endpoints, including automated or high-volume requests unrelated to normal product use • Use partner-lookup or invitation features to harass others or to probe accounts beyond the intended partner-sharing flow • Remove or obscure any copyright, trademark, or other proprietary notice in the Service • Use the Service in any way that violates applicable law
We may add, change, suspend, or discontinue any part of the Service at any time. Where a change is material and we can reasonably do so, we will provide notice in the Service or by email. We have no obligation to provide support or maintenance for the Service, although we try to help — support requests can go to support@gigglebaby.app.
If we discontinue a paid feature you have already purchased, your rights under the Subscriptions and purchases and Refunds sections, and under applicable consumer protection law, continue to apply.
Name data, rankings, meanings, origins, vibes, popularity statistics, and personalized suggestions are provided for informational and entertainment purposes. We do not guarantee that any name is unique, available, culturally appropriate, free of trademark or other third-party rights, or suitable for your child or any other purpose.
Provincial and territorial vital statistics offices set their own rules about what names may be registered on a birth certificate, including limits on characters, accents, and length. We do not verify that a name can be registered where you live. You remain solely responsible for any naming decision you make.
You retain ownership of the preferences, shortlists, notes, and other content you submit. You grant L12 Industries a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content as needed to operate, personalize, secure, and improve the Service, including sharing shortlists with a linked partner when you use partner features. This license ends when you delete the content or close your account, except for copies retained as described in the Retention section of our Privacy Policy.
You represent that you have the right to provide the information you submit (including family names and partner email addresses you enter) and that doing so does not violate others' rights.
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free license to use them for any purpose, without compensation or attribution to you. We are not obligated to act on feedback or keep it confidential, so please do not send us anything you consider proprietary or confidential. This does not affect our obligations regarding your personal information, which are set out in our Privacy Policy.
Share with Partner and related couples features are optional. You choose whom to invite. When you invite someone, they may see limited information about your account (such as your email and an approximate saved-name count). Linked partners can view each other's shortlists.
We are not a party to disputes between partners and are not responsible for a partner's use of information you share. You can leave a shared link as described in the product. Invitation links may expire.
Your interactions with other users of the Service, including a linked partner, are solely between you and them. We are not responsible for any loss or harm arising from those interactions. We may, but are not required to, get involved in disputes between users.
To the fullest extent permitted by applicable law, you release L12 Industries and its directors, officers, employees, and agents from claims and damages arising out of or related to disputes with other users or your use of third-party services. This release does not apply to any right or remedy that cannot be waived under Canadian or provincial law, including under consumer protection legislation.
Giggle Plus may be offered as a monthly, yearly, or lifetime in-app purchase through the Apple App Store or Google Play, facilitated by RevenueCat. Prices and features are shown in the app at the time of purchase and may vary by platform and region. Prices are shown in the currency your store account uses and may include applicable taxes such as GST or HST.
Auto-renewing subscriptions renew unless you cancel at least 24 hours before the end of the current period. Manage or cancel subscriptions in your App Store or Google Play account settings. Lifetime purchases, where offered, are one-time unlocks subject to the store's and our then-current product terms.
Purchasing may require a valid store account. We do not process your payment card directly.
Refunds for in-app purchases are handled by Apple or Google under their respective refund policies. L12 Industries does not directly process card refunds for App Store or Google Play purchases. Contact the applicable store for refund requests, or reach out to support@gigglebaby.app if you need help locating your purchase.
This does not limit any cancellation or refund right you have under applicable consumer protection law, including provincial legislation governing consumer agreements.
The following applies when you obtain a Giggle mobile app through the Apple App Store. These Terms are between you and L12 Industries only, not with Apple, and L12 Industries alone is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims under consumer protection or similar legislation, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Where you obtain the app through Google Play, your use is also subject to the Google Play Terms of Service, and Google is not responsible for the app.
You represent that you are not located in a country subject to a comprehensive Canadian or applicable trade sanction, and that you are not listed on any Canadian, U.S., or other applicable list of prohibited or restricted parties. You agree not to use, export, or re-export the Service in violation of Canadian export control and sanctions legislation, including the Export and Import Permits Act and the Special Economic Measures Act, or other applicable export laws.
The Service, including software, design, branding, curated editorial content, and the Giggle name and marks, is owned by L12 Industries or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership to you, and all rights not expressly granted are reserved. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly allowed by these Terms or applicable law.
Copyright © 2026 L12 Industries. All rights reserved. Trademarks, logos, and service marks shown in the Service belong to L12 Industries or to third parties, and may not be used without the owner's prior written permission.
If you believe content in the Service infringes your copyright, send a notice to support@gigglebaby.app. Under the notice-and-notice regime in section 41.25 of the Copyright Act (Canada), your notice should be in writing and include:
• Your name and address, and other information allowing us to contact you • Identification of the work or other subject-matter in which you claim copyright • The location data (such as a URL) of the material you say is infringing • A statement of the claimed infringement and your interest or right in the work • The date and time of the claimed infringement
We will forward valid notices as the Copyright Act requires. Please note that a notice may not be used to demand payment or settlement. We may also remove content or suspend accounts in accordance with these Terms.
The Service relies on and may link to third parties such as Apple, Google, RevenueCat, Supabase, hosting providers, analytics and crash-reporting providers, and AI providers. Your use of those services may be subject to their own terms and privacy policies. A link or integration is not an endorsement. We do not control and are not responsible for third-party services, and you use them at your own risk.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. It describes what personal information we collect, how we use and disclose it, how we handle AI-based personalization, where information is stored, and the rights available to you under Canadian privacy law.
By using the Service, you acknowledge that you have read the Privacy Policy and that we will handle your personal information in accordance with it. If there is a conflict between these Terms and the Privacy Policy about the collection, use, or disclosure of personal information, the Privacy Policy controls.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT SUGGESTIONS WILL MEET YOUR EXPECTATIONS.
Some jurisdictions, including provinces with consumer protection legislation such as Ontario and Quebec, do not allow the exclusion of certain warranties, conditions, or legal guarantees in consumer agreements. Where that legislation applies to you, the exclusions above apply only to the extent the law permits, and the warranties, conditions, and guarantees it provides continue to apply.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, L12 INDUSTRIES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) CAD $50. THE EXISTENCE OF MORE THAN ONE CLAIM DOES NOT INCREASE THIS LIMIT.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of Ontario or Canada, including liability for fraud, for personal injury or death caused by negligence, and certain consumer protection rights that may apply to you.
To the fullest extent permitted by law, you will indemnify and hold harmless L12 Industries and its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
We will make reasonable efforts to notify you of any claim we become aware of, and we may assume control of its defence and settlement. You agree to cooperate with that defence. This section does not apply where you are a consumer and applicable consumer protection law prohibits such an obligation.
You may stop using the Service at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonable and lawful, we will give you notice.
Provisions that by their nature should survive will survive termination, including Your content and preferences, Feedback, Intellectual property, Disclaimer of warranties, Limitation of liability, Indemnity, Your consumer rights, and Governing law and dispute resolution.
If you use the Service for personal, family, or household purposes, you are likely a consumer under provincial consumer protection legislation, such as Ontario's Consumer Protection Act or Quebec's Consumer Protection Act.
Those laws give you rights that cannot be waived by contract. Nothing in these Terms is intended to limit, and nothing should be read as limiting, any non-waivable right or remedy you have under them — including rights relating to legal warranties, cancellation of consumer agreements, disclosure of pricing and renewal terms, and access to the courts. If any provision of these Terms conflicts with a non-waivable consumer right that applies to you, that right prevails over the conflicting provision, and the rest of these Terms continue to apply.
If you are in Quebec, provisions of these Terms that would restrict your choice of forum or your ability to bring or join proceedings do not apply to you to the extent Quebec law says they cannot.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
Let's try to sort it out first. If you have a problem, please contact support@gigglebaby.app and describe the issue and the outcome you are looking for. Most concerns can be resolved this way, and we will make a good-faith effort to do so within 45 days.
If we cannot resolve it, you and L12 Industries agree that the courts of Ontario, Canada will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and each of us consents to that jurisdiction. This is subject to the Your consumer rights section above: if consumer protection legislation in your province or territory gives you the right to bring proceedings where you live, or to participate in a class proceeding, these Terms do not take that right away. Either party may also seek injunctive or other equitable relief from any court of competent jurisdiction to protect its intellectual property rights, and either party may bring an individual claim in small claims court.
We want Giggle to work for everyone, including people with disabilities. We aim to align the Service with the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA, consistent with the goals of the Accessibility for Ontarians with Disabilities Act and the Accessible Canada Act.
If you have difficulty accessing any part of the Service, or you have a suggestion for improving it, email support@gigglebaby.app. We will make reasonable efforts to respond promptly and to provide the information or function you need in an accessible format.
By using the Service, you consent to receive communications from us electronically, including by email to the address on your account and by notices posted in the Service. You agree that these electronic communications satisfy any legal requirement that a communication be in writing, consistent with Ontario's Electronic Commerce Act, 2000 and Part 2 of PIPEDA.
Commercial electronic messages, if we ever send them, are handled as described in the Electronic messages section of our Privacy Policy, in accordance with Canada's Anti-Spam Legislation. You may withdraw consent to receive commercial messages at any time; this does not affect transactional messages about your account.
These Terms and related documents were drawn up in English at the express request of the parties. Les présentes conditions et les documents qui s'y rattachent ont été rédigés en anglais à la demande expresse des parties. If we make a French version available and there is an inconsistency, the version that applies is the one required by applicable law, including the Charter of the French Language in Quebec.
These Terms, together with our Privacy Policy and any rules or guidelines posted in the Service, are the entire agreement between you and L12 Industries about the Service, and replace any earlier agreement on that subject.
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it, and any waiver must be in writing to be effective.
In these Terms, "including" means "including without limitation." You may not assign or transfer these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, financing, or sale of assets. These Terms bind and benefit each party's permitted successors and assigns.
We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice in the Service or by email to the address on your account where appropriate. Continued use of the Service after updated Terms take effect constitutes acceptance of the changes, except where applicable law requires a different process — including where consumer protection legislation requires your express consent to an amendment.
